This Intellectual Property & DMCA Policy explains how copyright, trademark, and other intellectual property concerns may be reported to Duckee Designs LLC, doing business as Wish Upon A Table ("Duckee Designs LLC," "Wish Upon A Table," "we," "our," or "us").

1. Intellectual Property Respect

Wish Upon A Table is committed to respecting intellectual property rights and responding appropriately to valid notices of alleged infringement.

If you believe content, functionality, branding, or materials available through the Service infringe your intellectual property rights, please contact us using the procedures described below.

Submission of a notice does not automatically establish infringement, and we reserve the right to evaluate all claims independently.

2. Copyright Complaints (DMCA)

If you are a copyright owner or authorized representative and believe material available through the Service infringes your copyright, please send a written notice containing:

  • Your full legal name;
  • Your mailing address;
  • Your email address;
  • A description of the copyrighted work claimed to have been infringed;
  • Identification of the material alleged to be infringing;
  • Information reasonably sufficient to permit us to locate the material;
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner;
  • Your physical or electronic signature.

Incomplete notices may delay review or prevent action.

3. Trademark Complaints

If you believe the Service improperly uses a trademark, service mark, logo, trade dress, or other brand identifier, please provide:

  • Your name and contact information;
  • Identification of the trademark or other rights claimed;
  • Registration information, if applicable;
  • A description of the allegedly infringing use;
  • Information sufficient for us to identify and evaluate the concern.

We will review trademark-related concerns and determine appropriate action based on applicable law and the specific circumstances involved.

4. Other Intellectual Property Concerns

For concerns involving:

  • Trade names;
  • Domain names;
  • Rights of publicity;
  • Proprietary content;
  • Licensing disputes;
  • Other intellectual property rights;

please provide a detailed written explanation and supporting information.

We reserve the right to request additional documentation before taking action.

5. Review Process

Upon receiving a notice, we may:

  • Review the claim;
  • Request additional information;
  • Contact the reporting party;
  • Contact affected parties;
  • Remove or modify content;
  • Decline to take action;
  • Take any other action we deem appropriate.

Nothing in this policy obligates us to remove content, disable functionality, or take any specific action.

All determinations are made at our sole discretion and in accordance with applicable law.

6. Misrepresentations

Submitting knowingly false, misleading, fraudulent, or materially inaccurate claims may expose the submitting party to legal liability.

We reserve all rights relating to fraudulent, abusive, or bad-faith notices.

7. No Affiliation with Third Parties

Wish Upon A Table is an independent reservation monitoring and notification service.

References to third-party businesses, restaurants, destinations, brands, trademarks, or services are used solely for identification, descriptive, informational, and nominative purposes.

Nothing on the Service should be interpreted as suggesting sponsorship, endorsement, authorization, partnership, or affiliation unless expressly stated.

All trademarks, logos, service marks, and trade names remain the property of their respective owners.

8. Reservation Information

Wish Upon A Table does not operate restaurant reservation systems and does not claim ownership of reservation availability information originating from third-party systems.

The Service provides monitoring and notification functionality only.
