1. Overview

These SMS Terms ("SMS Terms") govern the Wish Upon A Table text messaging program (the "Program").

The Program is operated by Duckee Designs LLC, doing business as Wish Upon A Table ("Wish Upon A Table," "Duckee Designs LLC," "we," "our," or "us").

By providing your mobile phone number and opting into text messages, you agree to these SMS Terms.

These SMS Terms supplement our Terms of Service and Privacy Policy.

2. Program Description

The Program delivers text messages relating to your use of the Service, including:

  • Reservation availability alerts
  • Account verification messages
  • Authentication codes
  • Security notifications
  • Account-related communications
  • Service announcements
  • Administrative notices

Messages may be sent using automated technology.

3. User Consent

You may opt into SMS messages by:

  • Creating an account and providing a mobile number;
  • Enabling SMS notifications within your account settings;
  • Providing consent through another approved opt-in mechanism.

By opting in, you expressly consent to receive recurring automated text messages from Wish Upon A Table at the mobile number provided.

Consent to receive text messages is not a condition of purchasing any product or service.

You represent that:

  • you are the authorized user of the mobile number provided;
  • you have authority to consent to receive messages at that number;
  • the information you provide is accurate and current.

4. Message Frequency

Message frequency varies.

The number of messages you receive depends on factors including:

  • the number of active monitoring requests you create;
  • reservation availability activity;
  • account activity;
  • security events;
  • support interactions.

Some users may receive multiple messages in a single day, while others may receive none.

We do not guarantee any minimum or maximum number of messages.

5. Costs and Charges

Duckee Designs LLC does not charge a fee for receiving SMS messages.

However, message and data rates may apply according to your wireless carrier's plan.

You are solely responsible for any charges imposed by your carrier.

Please contact your wireless carrier for information regarding your messaging plan.

6. STOP - Opting Out

You may opt out of receiving SMS messages at any time by replying:

STOP

to any message from us.

After receiving a valid STOP request, we will send a confirmation message and cease sending SMS messages to that mobile number, except as necessary to process the opt-out request or comply with legal obligations.

Because SMS opt-outs may be managed at the carrier level, SMS notifications may not be immediately restorable through account settings.

If you later wish to resume receiving messages, follow the instructions provided in the opt-out confirmation message or contact support.

Support requests may also be submitted through the Service.

8. Message Delivery Disclaimer

SMS delivery is not guaranteed.

Messages may be delayed, blocked, filtered, rejected, duplicated, or fail to arrive due to factors beyond our control, including:

  • carrier outages;
  • carrier filtering;
  • network congestion;
  • internet disruptions;
  • device settings;
  • software failures;
  • infrastructure failures;
  • third-party service interruptions.

Reservation availability may no longer exist when a message is received.

Duckee Designs LLC shall not be responsible for delayed, incomplete, misdirected, blocked, or undelivered messages.

9. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Supported carriers may change at any time without notice.

Carrier participation does not constitute endorsement of the Program.

10. Mobile Information Privacy

We respect your privacy.

Mobile phone numbers, SMS consent records, and SMS opt-in information will not be sold, rented, or shared with third parties or affiliates for their own marketing purposes.

Information relating to SMS communications may be shared with service providers as necessary to operate the Program, including telecommunications providers, messaging platforms, cloud hosting providers, and security vendors.

All use of personal information remains subject to our Privacy Policy.

11. Consent Records

To comply with applicable laws and industry requirements, we may maintain records relating to:

  • SMS consent;
  • SMS opt-out requests;
  • message delivery;
  • timestamps;
  • account activity;
  • IP addresses;
  • device information;
  • authentication events.

Such records may be retained after account closure where reasonably necessary to demonstrate compliance with legal obligations.

12. Eligibility

The Program is intended only for users who are at least eighteen (18) years of age.

By participating in the Program, you represent that you satisfy all eligibility requirements.

13. Program Changes

We reserve the right to modify, suspend, restrict, or terminate the Program at any time and without notice.

We may change:

  • message content;
  • delivery methods;
  • eligibility requirements;
  • supported carriers;
  • technical requirements;
  • Program functionality.

We shall not be liable for any modification, suspension, or discontinuation of the Program.

14. Disclaimer of Warranties

THE PROGRAM IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUCKEE DESIGNS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUCKEE DESIGNS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE PROGRAM.

OUR TOTAL LIABILITY RELATING TO THE PROGRAM SHALL NOT EXCEED THE GREATER OF:

(a) FIFTY U.S. DOLLARS ($50.00); OR

(b) THE AMOUNT PAID BY YOU TO DUCKEE DESIGNS LLC DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

16. Dispute Resolution and Severability

These SMS Terms incorporate by reference the Arbitration Agreement, Class Action Waiver, and Governing Law provisions of our Terms of Service, which apply to any dispute, claim, or controversy arising out of or relating to the Program, including under the Telephone Consumer Protection Act and similar laws, to the maximum extent permitted by law.

If any provision of these SMS Terms is held invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

17. Changes to These SMS Terms

We may update these SMS Terms at any time.

Updated SMS Terms become effective upon posting.

Continued participation in the Program constitutes acceptance of the revised SMS Terms.
